REFUND OBLIGATION AND EXCLUSION OF ADMIND'S LIABILITY
5. RETURN AND EXCHANGE OF TICKETS
5.1. RIGHT TO RETURN TICKETS / COMPLAINTS
The ticket buyer has the right to return tickets only in the following cases:
– event cancellation;
- postponement of the event for a period longer than 120 days from the day of the planned holding of the event;
- postponement of the event due to the occurrence of force majeure that lasts longer than 180 days from the day of the planned event.
Force majeure, during which the obligations of the Organizer stand still, occurs when the Event Organizer is unable to fulfill its obligation to hold the event due to war, rebellion, terrorist acts, strikes, accidents, fire, blockade, flood, decision or action of the epidemiological authority, natural disaster, severe disruptions in energy supply or anything else, for reasons beyond its power and control.
If the event is canceled or postponed due to the above circumstances, AdMind will inform the customers as soon as possible via the website www.e-tickets.me. If the event is postponed to a new date, refunds for purchased tickets to users who do not like the new date will be possible until the start of the event in the new date, unless the event organizer decides otherwise.
In the case of a refund to a customer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the refund, this refund is made exclusively via the same VISA, Maestro or MasterCard card that was used for payment. This means that our bank will refund the funds to the cardholder's account at our request.
In the case of a refund for a purchase made on the Internet store, the amount of the ticket price for the event in question will be refunded to the customer. A processing fee of 5% of the ticket price + 20 cents for the cost charged by the seat mapping software will not be refunded to the customer, as the AdMinda service is deemed to have been provided in its entirety at the time of ticket purchase, which the customer has been informed of and agreed to.
In the event of cancellation or postponement of the event or other program changes related to the event, no refund will be made for related expenses (eg transportation, hotel accommodation, delivery charges, etc.).
Complaint: With the introduction of the Law on fiscalization in the circulation of products and services, the ticket no longer has the value of a receipt, but a receipt is issued with the purchased ticket, which must be kept until the day of the event. If the event is postponed or cancelled, it is not possible to return the ticket and make a claim, i.e. refund without submitting a receipt proving the purchase of the ticket. 5.2. REFUND OBLIGATION AND EXCLUSION OF ADMIND'S LIABILITY
5.2.1. AdMind is not the organizer of the offered events. The event is organized, managed and implemented by the organizer, who also issues tickets. The organizer is solely responsible for refunding money to customers in case of cancellation or postponement of events described under point 5.1.
5.2.2. ADMIND d.o.o. acts exclusively as a distributor for the sale of tickets on behalf of the organizer, which is why it bears no responsibility in connection with the organization and/or holding of the event, and is not responsible for refunding money to customers in cases of cancellation or postponement of events described under point 5.1.
5.2.3. AdMind is obliged to refund ticket buyers on behalf of the Organizer only in the following cases:
- he did not transfer the money he collected on behalf of the Organizer to that Organizer and with a clear order in writing from the Organizer to refund the money to the customers on his behalf; or
– The Organizer transferred the funds to AdMind for the purpose of refunding the money to the ticket buyers with a clear order to refund the money to the buyers on behalf of the Organizer;
5.2.4. In cases where AdMind has the obligation to refund money to ticket buyers on behalf of the Organizer (paragraph three of this Article 5.2), AdMind will refund the money to the customer's current account or at the point of sale where the tickets were purchased, within:
– 90 days from the date of cancellation of the event,
- 60 days from the date of the planned event that has been postponed for a period longer than 120 days, i
- 240 days from the day of the planned event in the event of force majeure lasting over 180 days due to which the Organizer is unable to hold the event,
and all on the condition that the customer has submitted a request for a refund.
